How to Apply for the K3 Visa:

The application process for the K3 visa has these two steps:

Form I-130 and Form I-129F must be filed by the US citizen spouse and approved by USCIS.
A foreign spouse must apply for a K3 visa at a US Embassy in the country of residence.

To meet the requirements for the K3 visa, the US citizen must first file Form I-130 with USCIS on behalf of their spouse. Following the submission of the Form I-130 petition, the US citizen spouse must file Form I-129F, Petition for Alien Fiancé (e). Form I-797 and other supporting documents proving marriage must be attached to this form. The Form I-129F must also include any foreign-born dependents of the spouse, such as children. For the purposes of a K3 visa, there is no fee for this form.

The Form I-129F will be processed by USCIS and sent to the National Visa Center once approved (NVC). The NVC will assign the applicant a case number and an invoice ID number, and will send a package to the K3 applicant. The package will include information and instructions on how to apply for the K3 visa, as well as the necessary documents.

If USCIS processes and approves both Form I-130 and Form I-129F, sending them to the NVC, the applicant will be unable to obtain a K3 visa and must instead apply for a CR-1 visa. This is because the K3 visa is only available to those whose Form I-130 is still being processed and has not yet been approved.

Applying for a K3 visa:
